Wyoming rules for demand letters
Small claims court in Wyoming
The general small claims limit in Wyoming is $6,000. Wyoming requires you to ask for payment before you file in small claims court. Your affidavit must state that you demanded payment and the defendant refused.
The small claims court finder shows the filing fee for your amount, where to file and how to serve; our Wyoming small claims guide walks through the whole case.
Security deposits in Wyoming
The landlord must deliver or mail the deposit balance, with a written itemization of deductions, within 30 days after the rental agreement ends or within 15 days after receiving the renter's new mailing address, whichever is later. If the unit is damaged, that period is extended by 30 days. A landlord who unreasonably fails to comply can be ordered to pay the full deposit and court costs; there is no multiplier. The renter must tell the landlord, within 30 days after the agreement ends, where payment and notice can be sent. W.S. § 1-21-1208(a)
Within 30 days after the rental agreement ends, tell the landlord in writing where the payment and notice can be sent. The landlord's deadline can run from when the landlord receives your new mailing address.
Consumer protection notice in Wyoming
You can sue under the act only for an uncured deceptive trade practice. First give the business written notice that fully states the nature of the practice and the actual damage you suffered; you can sue if no offer to cure is made within 15 days after the notice (or an accepted cure is not carried out). The notice has its own time limits, and the lawsuit must start within one year after the notice is given.
What a demand letter should say
A demand letter is a short, factual request for payment. It names who owes whom, how much, and why; it sets a date to pay; and it says what you will do next if you are not paid. Keep it to what you could prove to a judge: the agreement, the dates, the amount, and any payments already made.
- Your name and mailing address, the date, and the other side's name and address.
- The amount you are asking for and how you got to it.
- A short account of what was agreed and what went wrong.
- A clear deadline and how to pay.
- Your next step if you are not paid, such as filing in small claims court.
Send it in a way you can prove, such as certified mail with a return receipt, and keep a copy for the court file.
