West Virginia rules for demand letters
Small claims court in West Virginia
The general small claims limit in West Virginia is $20,000. The West Virginia small claims sources we checked do not require a demand before filing, but a written demand is still useful evidence. No demand is required; you start a case by paying the fee and giving the clerk a short statement of your claim.
The small claims court finder shows the filing fee for your amount, where to file and how to serve; our West Virginia small claims guide walks through the whole case.
Security deposits in West Virginia
The landlord must deliver the deposit, minus deductions, with a written itemization within 60 days after the tenancy ends or 45 days after a new tenant moves in, whichever is shorter. If the landlord's noncompliance is willful or not in good faith, the tenant is entitled to the unreturned deposit plus damages of one and a half times the amount wrongfully withheld. The tenant is responsible for giving the landlord an accurate address. W. Va. Code § 37-6A-2(a)
Give the landlord an accurate mailing address in writing. West Virginia law makes that the tenant's responsibility.
Consumer protection notice in West Virginia
Before suing a seller, lessor, creditor or debt collector under the Consumer Credit and Protection Act (including unfair or deceptive practice claims), you must inform the business in writing of the alleged violation and its factual basis, by certified mail, return receipt requested, and wait 45 days. If the business makes a cure offer that is accepted and performed, that is a complete defense. We found no such requirement for a security deposit claim, which falls under a different chapter.
What a demand letter should say
A demand letter is a short, factual request for payment. It names who owes whom, how much, and why; it sets a date to pay; and it says what you will do next if you are not paid. Keep it to what you could prove to a judge: the agreement, the dates, the amount, and any payments already made.
- Your name and mailing address, the date, and the other side's name and address.
- The amount you are asking for and how you got to it.
- A short account of what was agreed and what went wrong.
- A clear deadline and how to pay.
- Your next step if you are not paid, such as filing in small claims court.
Send it in a way you can prove, such as certified mail with a return receipt, and keep a copy for the court file.
