Tennessee rules for demand letters
Small claims court in Tennessee
The general small claims limit in Tennessee is $25,000. The Tennessee small claims sources we checked do not require a demand before filing, but a written demand is still useful evidence. The court system's guidance we read does not require a demand before filing; the statutes could not be checked.
The small claims court finder shows the filing fee for your amount, where to file and how to serve; our Tennessee small claims guide walks through the whole case.
Security deposits in Tennessee
These rules apply only in Tennessee counties with more than 75,000 people (2010 census); in smaller counties the statute does not apply. Tennessee's deposit statute sets no day-count deadline for returning a deposit. A landlord who did not hold the deposit in the required account and did not provide a listing of damages may not keep any of it. If a refund is due, the landlord sends notice of the amount to the tenant's last known address, and may keep it if the tenant does not respond within 60 days. A tenant's claim is limited to the listed items the tenant specifically disputed. Tenn. Code § 66-28-301
If your rental is in a county with more than 75,000 people: at move-out, dispute in writing any item on the landlord's damage listing you disagree with; your claim is limited to items you specifically disputed. If the landlord sends a notice of the refund amount, respond within 60 days.
Consumer protection notice in Tennessee
The sources we checked show no general written-notice requirement before a consumer lawsuit under the Tennessee Consumer Protection Act of 1977. No pre-suit demand letter is required. A person may sue individually for actual damages, and if the violation was willful or knowing, the court may award three times actual damages. If the business made a written, reasonable settlement offer, the court may limit recovery to that offer.
What a demand letter should say
A demand letter is a short, factual request for payment. It names who owes whom, how much, and why; it sets a date to pay; and it says what you will do next if you are not paid. Keep it to what you could prove to a judge: the agreement, the dates, the amount, and any payments already made.
- Your name and mailing address, the date, and the other side's name and address.
- The amount you are asking for and how you got to it.
- A short account of what was agreed and what went wrong.
- A clear deadline and how to pay.
- Your next step if you are not paid, such as filing in small claims court.
Send it in a way you can prove, such as certified mail with a return receipt, and keep a copy for the court file.
