Ohio gym membership rules

The law: Prepaid Entertainment Contracts (Ohio Rev. Code 1345.41 to 1345.50). Read the law

Who it covers: The law covers health spa and gym contracts where you pay, or become obligated to pay, before receiving some or all of the service, and not contracts with nonprofit schools, government or nonprofit religious, ethnic or community organizations.

  • Cooling-off period: You can cancel a prepaid gym contract until midnight of the third business day after the first service is available to you (seventh business day if the facility was not open when you signed); business days exclude only Sundays and legal holidays. Source: R.C. 1345.43
  • How the club must let you cancel: A cooling-off cancellation is written notice to any facility address, the seller's email or its fax number, delivered by hand, certified mail return receipt requested (effective on postmark), email (effective when sent) or fax (effective when sent and confirmed). Source: R.C. 1345.43
  • Moving away: Ohio law requires prepaid gym contracts to provide that if you move 25 miles or more from the club and from any similar club that would honor the contract, and give written notice of the move asking to end the contract, you owe only for the days before you moved and get the excess back; the seller may require reasonable evidence. Source: R.C. 1345.42(B)(7)
  • Disability or illness: Ohio law requires prepaid gym contracts to provide that if disability keeps you from receiving the services, you owe only for the days before the disability and the seller returns the excess within 30 days after notice; no minimum duration or proof is set by the statute. Source: R.C. 1345.42(B)(5)
  • Death of the member: Ohio law requires prepaid gym contracts to provide that if the buyer dies, the contract is prorated to the date of death and the seller returns the excess to the buyer's representative within 30 days after notice. Source: R.C. 1345.42(B)(5)
  • Club closes or moves: Ohio law requires prepaid gym contracts to provide that if the club moves 25 miles or more from your home, or closes, and no similar club that would honor the contract is within 25 miles of your home, you owe only for the time before the move or closing and get the excess back. Source: R.C. 1345.42(B)(8)
  • Refund timing: After a valid cooling-off cancellation the seller must refund all payments within ten business days, but may keep or bill $10 if you already received your first service. Source: R.C. 1345.44(D)(4)

Re: Cancellation of membership

To whom it may concern:

I am writing to cancel my membership, effective immediately.

Please stop all further charges to my payment method, refund any amount paid for a period after the cancellation takes effect, and confirm the cancellation in writing, including the date it took effect.

Please keep this letter with the account records. I am keeping a copy, with proof of the date it was sent.

Sincerely,

[Member name]

Before you send (not part of the letter)

  • Ohio: A cooling-off cancellation is written notice to any facility address, the seller's email or its fax number, delivered by hand, certified mail return receipt requested (effective on postmark), email (effective when sent) or fax (effective when sent and confirmed). (R.C. 1345.43)
  • Refund timing in Ohio: After a valid cooling-off cancellation the seller must refund all payments within ten business days, but may keep or bill $10 if you already received your first service. (R.C. 1345.44(D)(4))
  • Send it in a way you can prove: a method your contract or state law names, and keep a copy. Certified mail with a return receipt gives you a dated record.
  • If charges continue after the cancellation takes effect, you can dispute them with your card issuer or bank (see the timing rules on this page).
  • Complaints: Ohio Attorney General, Consumer Protection Section, https://www.ohioattorneygeneral.gov/SpecialPages/File-Complaints
  • This letter is a starting point you edit and send yourself. It does not cancel anything by itself, and it is not legal advice.
