The law: Health Spas (Miss. Code Ann. Title 75, Chapter 83). Read the law

Who it covers: The law covers for-profit establishments offering weight control, exercise or dieting services (reducing salons, spas, exercise gyms, health studios, health clubs), but not nonprofits such as the YMCA whose fitness role is incidental, self-defense schools, nonprofit schools and colleges, or any business that offers no contract longer than four months.

  • Cooling-off period: You may cancel within five business days by written notice mailed or delivered by midnight of the fifth business day after purchase, and all money collected must be refunded. Source: Miss. Code Ann. 75-83-5(3)
  • How the club must let you cancel: Written notice counts as given if mailed or delivered by midnight of the fifth business day; the required contract notice tells buyers to mail it to the spa's address. Source: Miss. Code Ann. 75-83-5(3)-(4)
  • Disability or illness: Mississippi law requires health spa contracts to provide that if disability leaves you unable to receive the services, you are relieved of payments for services after the disability began and any unused prepaid amount is promptly refunded; a contract that does not comply is void and unenforceable. Source: Miss. Code Ann. 75-83-5(6), (7)
  • Death of the member: Mississippi law requires health spa contracts to provide that on the member's death the estate is relieved of payments for services after death and any unused prepaid amount is promptly refunded to the representative; a contract that does not comply is void and unenforceable. Re: Cancellation of membership

To whom it may concern:

I am writing to cancel my membership, effective immediately.

Please stop all further charges to my payment method, refund any amount paid for a period after the cancellation takes effect, and confirm the cancellation in writing, including the date it took effect.

Please keep this letter with the account records. I am keeping a copy, with proof of the date it was sent.

Sincerely,

[Member name]

Before you send (not part of the letter)

  • Mississippi: Written notice counts as given if mailed or delivered by midnight of the fifth business day; the required contract notice tells buyers to mail it to the spa's address. (Miss. Code Ann. 75-83-5(3)-(4))
  • Send it in a way you can prove: a method your contract or state law names, and keep a copy. Certified mail with a return receipt gives you a dated record.
  • If charges continue after the cancellation takes effect, you can dispute them with your card issuer or bank (see the timing rules on this page).
  • Complaints: Mississippi Attorney General, Consumer Protection Division, https://attorneygenerallynnfitch.com/divisions/consumer-protection/
  • This letter is a starting point you edit and send yourself. It does not cancel anything by itself, and it is not legal advice.
