Maternity Leave in Ireland 2026: Paternity, Parent's and Parental Leave Explained

Ireland's family-leave system has grown into a patchwork of five different entitlements: maternity leave, paternity leave, parent's leave, parental leave and adoptive leave. Each has its own length, its own payment rules and its own conditions, and the names are confusingly similar. Parent's leave and parental leave, in particular, are two entirely different things.

This guide maps the whole system for 2026: how long each leave lasts, who pays what (including the €299 a week benefit rate), what notice you must give your employer, and how your job is protected while you are away.

The table below is the whole map in one place. Every state payment listed is made by the Department of Social Protection (DSP), not by your employer.

How long is maternity leave in Ireland?

Maternity leave is 26 weeks, and every employee is entitled to it from the first day of a new job: there is no minimum service requirement. You must start your leave at least 2 weeks before the end of the week your baby is due, and you must take at least 4 weeks after the birth.

You can then take up to 16 additional weeks of maternity leave. This additional period is unpaid: Maternity Benefit does not cover it and your employer is not required to pay you for it.

The rules have been modernised in recent years. Since 20 November 2024, maternity leave can be postponed where the mother needs treatment for a serious illness. Where a baby arrives prematurely, extra leave and benefit cover the gap before the leave would ordinarily have started. In the tragic case of a stillbirth (since 16 September 2024, defined as a loss at 23 weeks' gestation or more, or a birth weight of at least 400g), the full leave and benefit entitlement still applies. And since 3 July 2023, maternity rights extend to transgender men who hold a gender recognition certificate.

Who pays for maternity leave: your employer or the State?

The State pays. Maternity Benefit is €299 a week in 2026, paid by the DSP for the full 26 weeks (156 days of benefit). It is taxable, but no USC or PRSI is deducted. To qualify you must meet PRSI contribution conditions, for example 39 weeks of PRSI paid in the 12 months before your leave; other qualifying routes are set out on the gov.ie Maternity Benefit page. Do not rely on the lower figure still quoted on some sites: that was the 2025 rate.

Your employer has no general legal obligation to pay your wages while you are on maternity leave. Many employers voluntarily top up Maternity Benefit to full or partial salary, but that is a matter for your contract or your employer's policy, not the law. Check your contract and staff handbook before you plan your finances around a top-up.

How does paternity leave work?

The second parent is entitled to 2 weeks of paternity leave, which must start within the first 26 weeks after the birth or adoptive placement. Starting in week 25 is fine; what matters is the start date, not finishing inside the window. Paternity Benefit is €299 a week for the 2 weeks, taken as one consecutive block, and the same employer rules apply: the DSP pays the benefit, and any salary top-up is optional. Same-sex couples are included on the same terms.

Parent's leave: 9 weeks per parent, and staying at 9 in 2026

Parent's leave gives each parent 9 weeks of leave during the child's first 2 years (or the 2 years after an adoptive placement), supported by Parent's Benefit of €299 a week. The entitlement increased from 7 to 9 weeks on 1 August 2024. You may see claims that it is rising again in 2025 or 2026: it is not. The official pages, current to March 2026, confirm the entitlement remains 9 weeks.

The leave belongs to each parent individually and cannot be transferred between parents, except where a parent dies. You can take it as one continuous block or in separate blocks of at least 1 week each. Apply for Parent's Benefit within 6 months of taking the leave; PRSI classes A, B, C, D, E, H and S are covered, and you qualify automatically if you qualified for Maternity, Paternity or Adoptive Benefit for the same child.

Parental leave: the unpaid 26 weeks

Parental leave is a separate entitlement, and the one most often confused with parent's leave. It gives each parent 26 weeks of unpaid leave per child, to be used before the child turns 12, or before their 16th birthday where the child has a disability or long-term illness. There is no social welfare payment attached: parental leave is entirely unpaid.

Unlike maternity leave, it is not a day-one right. You generally need a year's service with your employer before you can take parental leave, though a pro-rata entitlement applies once you have more than 3 months' service where the child is close to the age limit.

Unless your employer agrees otherwise, the leave is taken in one continuous period or in blocks of at least 6 weeks with a 10-week gap between them. Where you have more than one child, the maximum is 26 weeks in any 12-month period.

Think of the distinction this way: parent's leave is short, paid at €299 a week and confined to the child's first 2 years; parental leave is long, unpaid and available across the child's first 12 years, or 16 years where the child has a disability or long-term illness.

What notice must I give my employer?

Each leave type has its own written-notice rules, so treat notice as a formal step, not a conversation. Two of them carry the same hard statutory requirement: both parent's leave and parental leave need at least 6 weeks' written notice to your employer before the leave is due to start. That is a qualifying condition, not a courtesy.

For maternity, paternity and adoptive leave, give written notice as early as you realistically can, keep a copy, and be ready to provide supporting documents your employer is entitled to ask for, such as medical confirmation of the pregnancy and your expected due date. Is my job protected while I am on family leave?

Yes. On all of these leaves you remain in employment: annual leave continues to accrue, public holidays falling during the leave still count for you, and you have the right to return to your job.

PRSI credits work differently depending on whether a benefit is in payment. They are awarded automatically while you are getting Maternity Benefit. To keep getting credits during the unpaid additional 16 weeks of maternity leave, you must ask your employer to complete a maternity leave credits application after you return to work, so this is a step to diary rather than something that happens by itself.

The protection against dismissal is stronger still. Dismissing an employee for pregnancy, giving birth, breastfeeding or for exercising any statutory family-leave right is automatically unfair under the Unfair Dismissals Acts, and the usual 12-month service requirement does not apply, so the protection exists from day one.
