Delaware Bill of Sale Requirements
Delaware does not strictly require a separate bill of sale to title a vehicle, but one is strongly recommended as proof of the sale. Notarization is recommended but not required for a Delaware vehicle bill of sale.
- Delaware titles vehicle transfers using the Assignment of Certificate of Title on the back of the existing title; for a private resident-to-resident sale a separate bill of sale is not required by the DMV.
- A Dealer's Bill of Sale is required only when the vehicle is purchased from a dealer (per DMV form MV558, 'Documents Needed to Obtain a Delaware Title and Registration').
- Delaware titles do not require a notary; per the DMV title-transfer page and MV558, only out-of-state titles need notarization 'if stated notary seal required' by that other state.
- Delaware's DMV does not publish a standalone official bill-of-sale form, but it does publish a 'Report of Sale - With Buyer's Info' (Seller's Report of Sale) the seller files with the Division of Motor Vehicles to release liability.
- Although not required, a written bill of sale (VIN, odometer reading, price, date, buyer/seller names and signatures) is commonly recommended as proof of the transaction.
Odometer disclosure is federally required under the Truth in Mileage Act (49 CFR Part 580) for most vehicles under 20 model years old; a 2021 federal rule extended the disclosure period from 10 to 20 years for model-year 2011 and newer vehicles. In Delaware the disclosure is captured in the Odometer Disclosure/assignment section completed on the back of the certificate of title at transfer; per MV558 and the DMV title-transfer page, Delaware titles must be completed with mileage. Vehicles 20+ model years old and certain heavy vehicles are generally exempt from the federal requirement.
