Re: Request to inspect and review education records of [Student name] under FERPA

To whom it may concern:

I am the parent of [Student name], a student at [School or district name].

Under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. 1232g, and 34 CFR 99.10, I request the opportunity to inspect and review the following education records of my child: all education records directly related to the student.

Under 34 CFR 99.10(b), a school must comply with a request for access within a reasonable period of time, but not more than 45 days after it receives the request.

Under R.I. Gen. Laws 16-71-3(a)(1), a parent or eligible student has the right to personally inspect and review the student's records in existence at the time of the request that are required to be kept by law or regulation within ten (10) days of the request, made to the school's principal or designated appropriate authority.

I also ask for copies of these records. If there is a charge for copies, please tell me the amount before making them. Under 34 CFR 99.11(b), a school may not charge a fee to search for or retrieve a student's records.

Under R.I. Gen. Laws 16-71-3(a)(3), a parent or eligible student has the right to copies of the records, the cost per copied page of written records shall not exceed fifteen cents per page for records copyable on common business or legal size paper, and no fee will be assessed to search for or to retrieve the records.

Please do not destroy any of the requested records while this request is outstanding (34 CFR 99.10(e)).

Please contact me at the address above to arrange a time to review the records or to send the copies.

Please keep a copy of this letter with the student's education records. I am keeping a copy, with proof of the date it was sent.

Sincerely,

[Your name]

Before you send it (not part of the letter)

  • Rhode Island sets a shorter clock than FERPA for this kind of school: 10 calendar days (R.I. Gen. Laws 16-71-3(a)(1)). The clock runs from when the school receives the request, so allow for mailing time.
  • FERPA requires a school to give copies only when circumstances effectively prevent you from inspecting the records in person (34 CFR 99.10(d)); otherwise asking for copies is a request the school may grant. A school may charge for copies unless the fee would effectively prevent you from inspecting them (34 CFR 99.11(a)).
  • If the student is 18 or older, FERPA rights have passed to the student (34 CFR 99.5(a)(1)), and the student should send the letter.
  • Either parent keeps FERPA rights after a divorce or separation unless the school has a court order, state law or other legally binding document that specifically revokes them (34 CFR 99.4).
  • Rhode Island: A parent or eligible student has the right to a reasonable explanation and interpretation of the records. (R.I. Gen. Laws 16-71-3(a)(2))
  • Rhode Island: The records must be preserved as long as a request to inspect them is outstanding. (R.I. Gen. Laws 16-71-3(a)(4))
  • Send it in a way you can prove, such as certified mail with a return receipt or an email to the records office, and keep a copy.
  • If the school does not respond, a parent or eligible student can file a complaint with the U.S. Department of Education's Student Privacy Policy Office, generally within 180 days of the alleged violation or of when you knew or reasonably should have known of it (34 CFR 99.64(c)). Its complaint form is on studentprivacy.ed.gov.
  • This letter is a starting point you edit and send yourself. It is not legal advice.
