The law: Health Club Act (Act of Dec. 21, 1989, P.L. 672, No. 87; 73 P.S. 2161 et seq.). Read the law

Who it covers: The act covers health club contracts for services over a period of more than three months, but not bona fide nonprofit religious, ethnic, community or service organizations, government facilities, nonprofit schools, member-owned private clubs or diet-only weight programs.

  • Other rights to end the contract: Pennsylvania law requires health club contracts to let you cancel at any time until the club has given you a signed copy of a contract written in full compliance with the act. Source: Health Club Act section 3(a)(11)
  • Cooling-off period: You can cancel without penalty within three business days after signing and receiving a fully completed copy, and get all money back including any initiation fee; business days exclude Sundays and legal holidays. Source: Health Club Act section 3(a)(2), (b)(1)
  • How the club must let you cancel: For cooling-off, closure, death, disability and relocation cancellations, the buyer notifies the club in writing by certified mail, return receipt requested, or by personal delivery to the contract address; refunds and cancellation of automatic transfers are due within 40 days. Source: Health Club Act section 3(a)(8)
  • Moving away: A contract must let you cancel if you move more than 25 additional miles from the club and cannot transfer to a comparable facility within five miles of your new home; you get back what you paid beyond the weeks elapsed, less a fee of up to $100 ($50 if more than half the term has run). Source: Health Club Act section 3(a)(7)
  • Disability or illness: You can cancel for a physician-verified permanent disability, meaning you cannot use a third or more of the facilities for six months or more; a shorter disability earns a free extension instead. The club may require an exam by a physician both agree on, at its cost, and may deduct a fee of up to $100 ($50 late in the term). Source: Health Club Act section 3(a)(5)-(6)
  • Death of the member: The buyer's legal representative may cancel if the buyer dies, with a refund of amounts paid beyond the weeks elapsed less a fee of up to $100 ($50 late in the term). Source: Health Club Act section 3(a)(6)
  • Club closes or moves: If the club closes for more than 30 days and offers no comparable facility within ten miles, you can cancel for a pro rata refund; a closure of 30 days or less gets you an equal extension, and a contract signed within 30 days of a club closing is voidable. If the club was not completed and operational when you signed, the contract must let you cancel without penalty for a full refund, including any initiation fee, if it is not open by the date in the contract, or within three business days after it opens or you receive notice of its opening, whichever is later. Source: Health Club Act sections 3(a)(3)-(4), (9), 8
  • Military service: A Pennsylvania National Guard or reserve member called to active duty (not training) for 30 or more consecutive days may terminate without cost or penalty, or suspend, a health club or fitness center membership incurred before active duty, using written notice. Source: 51 Pa.C.S. 7315(a), (e)
  • Automatic renewal: A Pennsylvania health club contract may run at most 36 months and may not contain an automatic renewal clause; any renewal must be an option you affirmatively accept at the end of each term. A contract that does not comply with the act is voidable at your option. Source: Health Club Act sections 4, 7 (73 P.S. 2164, 2167)
  • Refund timing: Refunds after any statutory cancellation are due within 40 days of the club receiving the notice. Source: Health Club Act section 3(a)(8)

To whom it may concern:

I am writing to cancel my membership, effective immediately.

Please stop all further charges to my payment method, refund any amount paid for a period after the cancellation takes effect, and confirm the cancellation in writing, including the date it took effect.

Please keep this letter with the account records. I am keeping a copy, with proof of the date it was sent.

Sincerely,

[Member name]

  • Pennsylvania: For cooling-off, closure, death, disability and relocation cancellations, the buyer notifies the club in writing by certified mail, return receipt requested, or by personal delivery to the contract address; refunds and cancellation of automatic transfers are due within 40 days. (Health Club Act section 3(a)(8))
  • Refund timing in Pennsylvania: Refunds after any statutory cancellation are due within 40 days of the club receiving the notice. (Health Club Act section 3(a)(8))
  • Send it in a way you can prove: a method your contract or state law names, and keep a copy. Certified mail with a return receipt gives you a dated record.
  • If charges continue after the cancellation takes effect, you can dispute them with your card issuer or bank (see the timing rules on this page).
  • Complaints: Pennsylvania Office of Attorney General, Bureau of Consumer Protection, https://www.attorneygeneral.gov/submit-a-complaint/consumer-complaint/
  • This letter is a starting point you edit and send yourself. It does not cancel anything by itself, and it is not legal advice.
